Overview of Subscription Plans

We offer limited-scope legal services through a monthly subscription model, sometimes referred to as “unbundled legal services.”  For most individuals, our Legal Essentials Access Plan will be the option of choice. This plan is designed to be affordable, provide basic legal support, and give you piece of mind without the additional costs related to full litigation or representation. This structure includes legal advising, document review, strategic consultations, and emergency guidance. These plans provide practical legal guidance from an experienced attorney who understands your goals. The subscription model is designed to be flexible, affordable, and proactive, helping you stay legally prepared without the financial uncertainty of traditional hourly billing or requiring large retainer fees.

For nonprofits and businesses, the Legal Strategy Plan will be the plan of choice.  This plan allows the organization to secure, in effect, a fractional General Counsel to help pursue your mission, provide expertise in land use and nonprofit administration law, and to keep your mission moving forward.

* Note: We offer discounted rates, on a sliding scale, for federal employees, military members, and those under financial hardship. Of particular importance to me are seasonal park rangers and lower ranking active duty military, who will receive a 50% discount. Often called “unbundled legal services,” this model includes advising, document review, strategy sessions, and emergency consultations — without requiring full litigation, complex matters, or courtroom representation. Whether you're preparing an application, researching your benefit eligibility, responding to an agency, reviewing an agreement, facing a big decision, or just needing someone to bounce ideas off of, this plan gives you access to experienced legal guidance from an attorney who understands your goals and who's been in your shoes. It’s a flexible, affordable way to stay legally prepared — with the confidence of knowing you’re not navigating it alone.

This plan has been designed to comply with the Missouri Rules of Professional Conduct, including Rule 4-5.5 (Multijurisdictional Practice) and Rule 4-1.6 (Client Confidentiality), and follows ABA guidance on limited-scope and subscription-based services.

What's Included:

  • Unlimited Priority Legal Advising, Technical Consulting, or General Legal Information: Note: Unlimited consultations are subject to reasonable use standards to ensure availability for all subscribers. 

    • Unlimited short strategic consultations via email, phone, client portal, or virtual meetings — ideal for reviewing options, preparing next steps, or identifying risk areas. 

      • Zoom and Teams meetings, phone calls, use of the client portal, and email are all available. ​

      • ​Good for setting up strategy for how to deal with CO applications, performance issues, harassment complaint strategy, hostile work environments, career counseling, reasonable accommodation requests, nonjudicial punishment guidance, etc, ​

      • Understanding and navigating processes, such as career advancement, workplace protections, workplace rights, protest and social media rights, employee benefits, whistleblower, complaints, RIF's, EEO, 16E, CO, Article 15, Article 32, etc.

      • Guidance for employees in security-sensitive roles, including support during clearance reviews, PRP removals, SAP access issues, and classified employment disputes.

    • Questions outside of my expertise or specific to state law will be referred to local licensed counsel if needed.

    • While we offer strategic consulting support through the Law Office of D.C. Burnette, PLLC, not all services constitute legal advice. Clients will be clearly informed when services fall outside the scope of an attorney–client relationship.

  • Document Review and Drafting (Up to 10 Pages Per Month): 

    • Review of agency responses, employment agreements, Position Descriptions, relocation incentives, severance agreements, resignations letters, agency demands, reasonable accommodations, LOR's, and performance appraisals.

    • Limited drafting of responses, employment agreements, resignations letters, agency demand responses, reasonable accommodations requests, LOR's and responses, performance appraisals demands, PIPs, and similar. 

  • Recreation Use or Public Land Access Permits for Individuals or Small Groups

    • ​Assistance applying for camping, hiking, river rafting, biking, ATV, photography, filming, Annual Public Lands Passes, day use or timed-entry permits, etc. 

  • Priority Emergency Response (Within 24 Business Hours): 

    • Immediate consultation and legal guidance during arrests, disciplinary threats, firing actions, enforcement actions, or civil rights violations.

    • Assistance connecting with and coordinating with licensed local counsel if formal court representation is required in another jurisdiction.

    • Pro hac vice coordination is considered if necessary for formal appearances. Must sign a separate agreement for matters beyond the scope of this plan.

  • Discounted Rates for Matters outside the Scope of this Plan: 

    • Litigation, Appeals, and Complex Representation-such as MSPB representation, EEOC claims, Nonjudicial punishment representation, USMJ hearings, CO application packages, etc. 

    • Application preparation, document drafting, or written legal guidance that extends beyond the scope of this plan.

    • Services outside the subscription require a separate written engagement agreement and may involve additional fees.

    • Disability applications or appeals, civil rights actions, and related issues may be added on under a contingency fee agreement, for a discounted rate, and only payable on the successful outcome of your case.  

    • Depending upon the situation, you may want to move to a higher level subscription to reduce costs. 

  • Conflict Check and Retainer-on-File: 

    • Subscribers are pre-cleared through conflict checks and maintain a limited-scope retainer agreement, ensuring availability and priority when additional services are needed.

  • Secure Client Portal Access: 

    • Access to the Firm's Client Portal account, a secure client portal, for secure messaging, document sharing, and appointment scheduling.

  • Access to Curated Resources & Tools

    • Member's Only Dashboard with link to the Client Portal and Private Chat Function

  • Optional Annual Legal Check-In: 

    • Once per year, subscribers may schedule a longer strategy session (30–45 minutes) to review ongoing legal goals, evaluate risk areas, or plan ahead for upcoming matters.

  • Priority Access to Templates and Self-Help Resources: 

    • When appropriate, subscribers may receive attorney-reviewed sample letters, checklists, or self-help guides to support early action or help them prepare for more formal steps.

  • Access to Newsletter and other Communications: 

    • Keep up with legal issues, current affairs, or firm news through email, my Blog, and a curated Video Gallery showcasing issues of concern to Clients.

    • Suggestions for topics will be solicited from Clients. 

What's Not Included:

  • Full litigation, court or other appearances, administrative hearings, or other representation (unless retained separately)

  • Limited drafting of legal filing documents (pleadings, filings - determined case by case)

  • Preparation of applications, appeals, appeals briefs, agency filings, or formal petitions (However, helping you prepare these are covered)

The Law Office of D.C. Burnette offers flat-fee, contingency fee, and hourly legal services for subscribers at rates approximately 25% below the average charged by comparable federal practice law firms. These discounts are available exclusively to clients with an active subscription through one of our Subscription Plans. Other clients will pay the standard rate. This model reflects our commitment to making high-quality legal guidance more accessible for individuals, employees, and small organizations navigating government systems.

Hourly Fee Services

  • Standard Legal Advising & Strategy: Included in all Subscriptions. (Non-Subscriber Rate: $300/hour)

  • Federal Appeals & Complex Matters: Included in all Subscriptions. (Non-Subscriber Rate: $400/hour)

  • All other services will be done on a flat fee or contingency fee model. 

Contingency Fee Services

  • In rare cases, or if a matter requires it under federal law, a contingency fee agreement may be appropriate. 

  • A contingency fee is a payment structure where a lawyer's fee is only paid if the case is won, and it's a percentage of the total recovery.

  • In Cases where a contingency fee is appropriate, as a subscriber, this fee will be limited to 20% of the overall award, subject to any federally imposed cap, instead of the industry standard of 25-30%. Non-subscribers will be subject to the higher industry standard pricing.

Note: Clients enrolled in a subscription plan receive the discounted pricing listed here, as well as guidance, advising, and some items on this list without having to pay an additional fee. Clients receiving a discounted rate for subscriptions may have to pay a fee for items below, dependent upon the client's situation. Non-subscribers will be charged the full standard rate. We are currently not offering any of the services below to anyone who is not a subscriber.
